These terms and conditions apply to participation in all sweepstakes organized by ProSiebenSat.1 PULS 4 GmbH and its subsidiaries (Sweepstakes Organizer), Media Quarter Marx 3.1, Maria Jacobi Gasse 1, 1030 Vienna, unless and to the extent that the respective sweepstakes specify otherwise.
In principle, all natural persons over the age of 14 are eligible to participate, unless otherwise stated in the respective sweepstakes, in which case the deviating regulation shall apply. Participants under the age of 14 have no legal claim to winnings. Owners, employees and other staff members of the PROVIDER of the WINNER'S GAME and all staff members of participating third party companies involved in the implementation of this prize draw, as well as persons living in a cohabitation relationship with the aforementioned persons, are excluded from participation. Substitution for participation in the competition is excluded.
The winner will be notified by the organizer after the end of the competition. Unless otherwise stated in the prize notification, the respective winner must accept the prize within 2 months of notification of the prize in the case of a material prize, and in the case of an event prize, the winner must accept the prize within one week before the event in question. If the prize is not accepted within this period or within the period stated in the prize notification, the claim to the prize shall automatically lapse and the prize shall be awarded again.
If participation in the competition requires the sending of materials, each participant assures that he/she is the sole owner, holder and beneficiary of all rights of use and exploitation of the material sent in. By submitting, each entrant grants to the Sweepstakes Organizer, without limitation, all rights of use and exploitation in the material provided (including, but not limited to, the right to broadcast, reproduce, distribute, make available, perform, publicly perform, and all of the foregoing, including in edited form and in combination with third party material).
Sweepstakes organized via Social Media are not connected to the respective Social Network and are in no way sponsored, supported or organized by the respective Social Network. The recipient of the data provided by the participants is not the respective Social Network, but the WINNER GAME ORGANIZER. The data provided by the participant will only be processed for the purpose of determining and contacting the winner and administering the prize. Questions, suggestions and complaints should therefore be addressed exclusively to WINNER'S GAME PROVIDER. The WINNER'S PROVIDER may use third parties to process this data. Further information on the processing of personal data can be found in the data protection provisions of the PRIZE-GAME PROVIDER.
Participation in the competition is free of charge and independent of the purchase of goods or services. By participating in the competition, the user accepts these conditions of participation.
A cash payment of the prize is not possible. Winnings are not transferable and there is neither a right of return nor a right of exchange. The WINNER reserves the right to replace the prizes with equivalent other prizes.
In the event of a breach of the conditions of participation or in the event of intentional or unintentional misrepresentation with regard to the conditions of participation, the PROVIDER OF THE WINNER GAME reserves the right to exclude the relevant persons from the prize draw. Persons who use unauthorized aids or otherwise obtain advantages through manipulation will also be excluded. In such cases, prizes may also be subsequently disallowed and reclaimed.
The LOTS PROVIDER shall not be liable for damages caused by errors, delays or interruptions in data transmission, malfunctions of technical equipment and services, incorrect content, loss or deletion of data and viruses.
The CONTEST PROVIDER reserves the right to cancel or terminate the contest at any time without notice and assumes no responsibility for lost chances of winning.
Should any provisions of these terms and conditions of participation conflict with the provisions of the general terms and conditions of use, the provisions of the general terms and conditions of use shall prevail.
If any provision of these Terms and Conditions of Participation is or becomes invalid, the validity of the other provisions shall not be affected.
The CONTEST PROVIDER reserves the right to amend or supplement these Terms and Conditions of Participation at any time without stating reasons, insofar as this is necessary in the interest of simple and secure processing and in particular to prevent abuse or for other reasons.
Austrian law shall apply exclusively to the implementation of sweepstakes by the sweepstakes organizer. Insofar as this does not conflict with mandatory statutory provisions, the court with subject-matter jurisdiction for the first district of Vienna shall be responsible for deciding all disputes arising from this contract.
